Employment Discrimination And Its Redressal
Discrimination of any kind in employment is wrong. Employment discrimination has a bad impact on qualified individuals who are denied the right of a job, or are discriminated on grounds of race, religion, or sex in the workplace. It is a kind of mental harassment in which effective persons are denied active participation in any state or local or private sector of job.
The US constitution forbids any kind of job discrimination by the local, state, or federal government as well as by private organizations. Laws have been formulated under various Acts that protect employees from unlawful discrimination by employers during the process of employee recruitment removal and , work harassment, promotion opportunities, job assignments, or any compensation.
The Fifth Amendment of the US Constitution states that no individual will be deprived of life, liberty, or property by the federal government without recourse to the right processes of the law.
The amendment also assures that each and every individual would enjoy the right to have equal protection under the laws of the US. Vide the Fourth Amendment of the US Constitution clearly notifies the states that they should not violate the rights of an individual. In case, a worker is fired, there should be a fair procedure and it must be legal.
The various non-discrimination laws of the US prohibit employment discrimination on the following basis:
Race or Color: No person shall be employed based on his color or race. Deserved and qualified individuals with potential cannot be denied the right to have a job. They must not even be subjected to any kind of harassment within the work place with abusive language or any derogatory remarks.
National or Ethnic Origin: While an employer employs an individual, the caliber of the employee should be taken into account rather than his ethnicity or nationality. A person denied a job on the said grounds is considered as discriminated against as per law.
Gender or Sex: There shall be no discrimination in job opportunities or any other facilities based on the sex of the individual. Everyone has equal opportunities.
Pregnancy: Women employees cannot be discriminated against based on their right to maternity leave and payment. Every employer must respect the basic laws that safeguard the rights of a pregnant woman employee.
Employment discrimination is also prohibited on other grounds such as religion, language abilities, political affiliation, disability, age, medical conditions, gender identity, sexual orientation, military veterans, marital status, and others. There are laws to prohibit discrimination against some special social groups for their upliftment.
The US government has enacted various Acts to prohibit discrimination in employment. These Acts protect the rights of the employees who have equal skills, ability to bear responsibility, provide full effort under the same working conditions like others, yet face employment discrimination. The Equal Employment Opportunity Commission (EEOC) looks after such matters and tries its best to stop such illegal practices.
